Private vehicles carrying passengers 12 years and below required to have child car seats starting Feb. 2

A law meant to save children from injury or the Child Safety in Motor Vehicles Act signed by President Rodrigo Duterte will be fully implemented on February 2, 2021.

The R.A. 11229 mandates the use of child restraints system (CRS) or car seats while transporting children aged 12 and below who are shorter than 4'11". 13 years old or older are allowed to take the passenger front seat.

The law even punishes drivers who leave children inside a car unattended.

Public utility vehicles like taxis, vans, school buses and regular passenger buses are not yet covered. However, the Department of Transportation (DOTr) will be conducting a feasibility study to determine if public transport will be required to adopt CRS use.

Anyone who will violate are expected to face fines. Under the implementing rules and regulations, drivers caught with child passengers without CRS seated in front-seat who are below 12 years old will be fined P1,000 for the first offense; P2K for the second offense; and P3K and a one-year suspension of the driver's license for the third and succeeding offenses.

Based on the data unveiled during the virtual press briefing, there are 12,487 deaths recorded in 2018 due to road accidents, while there are 1,226 children deaths due to road accident in 2017, which shows 3 children deaths per day.
